Consultation clause in modern awards (AM2013/24)

Item 19 of Schedule 1 of the Fair Work Amendment Act 2013 - the Fair Work Amendment Act amended the Fair Work Act 2009 by inserting a new requirement in section 145A that all modern awards must include a term dealing with consultation about changes to rosters or hours of work.

The Full Bench also considered how the proposed consultation clause would interact with existing award provisions in relation to notice required prior to changes to rosters and part-time work patterns. A list of such provisions was compiled by staff of the Fair Work Commission and can be downloaded through the link below. It was proposed that any award that contains such provisions will, in addition to the proposed clause contained in Attachment A to the Statement of 7 November 2013, include a new paragraph:

X.2(c) These provisions are to be read in conjunction with [reference to existing award provision re notice requirements]

Security Services Industry Award 2010

Two draft determinations relating to the above award were published for comment. The purpose of the draft determinations was to correct an administrative error contained in determination PR546288 issued on 24 December 2013.
